MTG REO Litigation Consultant- Job # 222644
This job exists to collaborate with REO Management and internal legal staff to develop recommendations for negotiation and resolution of the continuous stream of lawsuits filed against SunTrust and its investors. Addresses and resolves faulty foreclosure actions, where possible, short of re-foreclosure, as well as loans broken at origination. In addition, the incumbent will be expected to anticipate and/or ensure resolution on other legal matters (e.g., contract disputes, wrongful eviction, wrongful foreclosure, etc.) arising in the context of REO disposition. Interprets important business issues and recommends 'best practices' resolutions. Works independently with guidance only on most complex situations.
With oversight, ensures resolution on a caseload of litigation and pre-litigation actions. Develops and resets litigation strategies as situations warrant. Meets with internal and external clients and counsel to gather facts and develop recommendations. Represents Suntrust and its investors at trials, depositions and mediations. Manages hundreds of actions per year representing hundreds of millions of dollars in risk. Responsible to develop and implement complex litigation resolutions within specified authority limits. Participates in policy and procedure documentation changes and audits. Performs successful litigation resolution to reduce risk exposure.
Manages a caseload of litigation and pre-litigation actions to resolution. Develops and resets litigation strategies as situations warrant. Meets with internal and external clients and counsel to gather facts and develop recommendations. Represents Suntrust and its investors at trials, depositions and mediations.
Reads, analyzes, and understands complex legal documents. Analyzes plaintiff claims. Considers and evaluates costs for alternate strategies for resolution. Utilizes knowledge of foreclosure and real estate law to develop written recommendations blending risk, time, and cost for thorough litigation analysis.
Confers with investors and internal partners (e.g., Legal, Foreclosure, Loss Mitigation, Default Accounting, Bankruptcy and Default) to create a forensic reconstruction of the facts surrounding plaintiff case. Assesses validity of plaintiff claims and conducts and documents cost-benefit analysis.
Minimum Requirements: Bachelors degree in Business, Finance, Real Estate or related area. Paralegal Certificate. 10 years of experience in real estate, sales, closing, legal, title, or related financial services environment. Thorough knowledge of Real Estate and Foreclosure Law. Experience in caseload management in a fast paced environment.
Preferred Requirements: 10 years of experience in legal setting or 2 of the following areas: Real Estate, Sales, Closing, Legal, Title or related Financial Services environment.
